Terms of Service

1. Agreement

These Terms of Service (“Terms”) are an agreement between you and ZayneSoft LLC (“ZayneSoft”, “we”, “us”) covering your use of the Mail Buddy desktop application for macOS and Windows (“Mail Buddy” or “the app”). By installing or using Mail Buddy, you agree to these Terms. If you do not agree, do not install or use the app. If you use Mail Buddy on behalf of a business, you confirm that you may accept these Terms for that business.

2. Your license

ZayneSoft grants you a personal, non-exclusive, non-transferable, revocable license to install and use Mail Buddy on computers you own or control, for your own personal or internal business purposes. You may not:

  • sell, rent, sublicense or redistribute the app, except as ZayneSoft allows in writing;
  • copy, modify, reverse engineer or decompile the app, except where the law allows this despite this restriction;
  • remove any copyright or other notices from the app.

ZayneSoft keeps all rights, title and interest in Mail Buddy, including its name, design and code.

3. Google accounts and services

Mail Buddy works with Gmail and Google Chat through Google's official interfaces. To use it, you sign in to your own Google accounts and allow the app the access described in our Privacy Policy.

  • Your use of Gmail, Google Chat and your Google accounts remains subject to Google's own terms and policies, and, for work accounts, to your organization's rules.
  • Mail Buddy depends on Google's services. If Google changes, limits or stops a service, some features may stop working.
  • ZayneSoft is not affiliated with or endorsed by Google. Gmail and Google Chat are trademarks of Google LLC.

4. Acceptable use

You are responsible for how you use Mail Buddy and for the messages you send with it. You agree not to use the app to:

  • send spam, bulk unsolicited messages, or phishing or fraudulent messages;
  • break any law, or infringe anyone's rights, including privacy and intellectual property rights;
  • access an account you are not authorized to use;
  • interfere with Google's services or try to get around their limits or security.

5. Your content

Your email, chats, contacts and files belong to you. ZayneSoft does not receive them and claims no rights to them. Mail Buddy processes them only on your computer, and only to provide the app's features.

6. Privacy

Our Privacy Policy explains what data Mail Buddy accesses and how it is handled. It forms part of these Terms.

7. Updates

We may release new versions of Mail Buddy that add, change or remove features. We may also stop offering or supporting the app at any time. Updates are covered by these Terms unless they come with different terms.

8. Ending use

You may stop using Mail Buddy at any time by removing your accounts in the app and uninstalling it. We may end your license if you seriously or repeatedly break these Terms. When your license ends, you must stop using the app and uninstall it. Sections 2 (ownership), 9, 10, 11 and 13 continue to apply afterwards.

9. No warranty

Mail Buddy is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. ZayneSoft does not promise that the app will be uninterrupted, error-free or always able to reach Google's services, or that it will never lose or misdeliver a message.

Keep important messages in your Google account, and check that important messages were delivered.

10. Limitation of liability

To the fullest extent the law allows, ZayneSoft will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business, arising from your use of or inability to use Mail Buddy. ZayneSoft's total liability for any claim relating to the app will not exceed the greater of the amount you paid for the app in the 12 months before the claim, or one hundred US dollars (US $100).

Some places do not allow these limits, so some of them may not apply to you.

11. Governing law

These Terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New York, and you and ZayneSoft agree to those courts' jurisdiction.

12. Changes to these Terms

We may update these Terms. We will post the new version on this page and change the date at the top. If you keep using Mail Buddy after a change takes effect, you accept the updated Terms.
